Terms of Service
Draft — pending legal review. This is not final legal text.
1. Who we are and what these terms cover
Broadcast (“we”, “us”) is operated by AB Ventures. These terms are the agreement between us and the business or person who signs up (“you”). By ticking the box when you create an account, or by using the service, you agree to them. You must be at least 18 and be using Broadcast for business purposes.
2. The service
Broadcast helps you write and send outreach messages by email, LinkedIn and Instagram, and track replies. Messages are sent from your own connected accounts, to the people you choose, using content you approve. We do not supply contact lists and we are not the sender of your messages.
3. You are responsible for your outreach
You decide who you contact and what you send, so you are responsible for making sure your outreach is lawful. In particular you must:
- have a lawful basis to contact each person, and comply with the laws that apply to you and to them, such as CAN-SPAM, the GDPR and PECR, and CASL;
- identify yourself honestly and not use misleading subject lines, sender names or claims;
- include a valid postal address in your account settings, and honour opt-outs on every channel. We add an unsubscribe link to emails and, when someone uses it, stop emailing them from your workspace. We cannot see or act on opt-outs made anywhere else, such as a reply on LinkedIn or Instagram, and staying within the law remains your responsibility;
- only import data you are entitled to use, and not send spam, harassment, or unlawful content;
- not try to get around the sending limits we apply.
4. Other platforms’ rules and your account risk
LinkedIn, Instagram and email providers have their own terms, and those terms may restrict or prohibit automated or bulk messaging. Using Broadcast may result in a platform limiting, suspending or banning one of your accounts. You accept that risk. We apply conservative sending limits, but we do not control those platforms and we do not guarantee that your accounts will not be restricted, that your messages will be delivered or seen, or that you will receive any particular number of replies.
5. AI-generated content
Some message drafts are written by AI. AI-generated text can be wrong, can misstate facts, and can be unsuitable. We design the service for you to review drafts before they are sent, and you are responsible for everything that is sent from your accounts, including if you switch on automatic sending. We do not guarantee that AI-generated content is accurate or appropriate.
6. Credits and enrichment
Some features, such as email verification and finding profiles, use credits. Your plan may include a monthly credit allowance, and you can buy extra credit packs. The amount, and any cap on how many credits you can hold, is shown in the app and may change. Credits have no cash value and cannot be transferred. Enrichment and verification results come from third parties and may be incomplete or out of date.
7. Subscription, trial and payment
- A subscription is charged per workspace, per month, at the price shown at checkout. New customers may get a free trial; a payment card is required, and the subscription renews automatically when the trial ends unless you cancel first. The trial is available once per account, and we may refuse repeat trials.
- You can cancel at any time from your billing settings; cancellation takes effect at the end of the period you have paid for.
- Prices exclude any applicable taxes. We will give notice before changing the price of an existing subscription.
- Payments are processed by Stripe. Fees are non-refundable except where the law requires otherwise.
8. Your data and privacy
You keep ownership of the data you bring to the service. For personal data about the people you contact, you are the controller and we are your processor; our Data Processing Agreement explains how we handle it, and our Privacy Policy lists the providers we use. Authorised staff may access account data to give support and to investigate abuse.
9. Suspension and ending the agreement
We may pause sending, suspend, or end your account if you break these terms, if your use puts other customers or the service at risk, if a payment fails, or if the law requires it. You can stop using the service and cancel at any time. After cancellation we keep your data for a limited period and then delete it.
10. Availability and changes
We work to keep the service running but do not promise it will be uninterrupted or error-free. Current status is published on our status page. We may improve or change features, and we may update these terms; where a change is significant we will tell you in advance.
11. Liability
The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential loss, lost profits, or loss caused by third-party platforms, and our total liability to you is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot lawfully be limited. You will cover losses we suffer from claims arising out of your outreach, your content, or the data you import.
12. Governing law
These terms are governed by the laws of England and Wales, and the courts of that jurisdiction have jurisdiction over any dispute.
A full, lawyer-reviewed version of these terms will be made available before general availability.
